If you have become the victim of a punishable offence, such as a violent crime, sexual offence, or if you are being extorted, then you can always and safely go to the police to file a report.

Note! You can also do this even if you are not living in the Netherlands legally or work in an unlicensed industry!

When filing a report, you can always bring someone for support. The P&G292 confidentiality team will also gladly come along with you. However, if you are too afraid to go to the police station, then the confidentiality team can also invite the police to come to P&G292 for you, or to a different neutral place for an orientation meeting.

Answers to sex workers’ questions for the police:

Will the police share my information with the municipality or another authority if I report an offence?

The police will not share your information, not even with the municipality. The police will only record whatever is required to find the offender. During the first meeting, the police can explain to you exactly which information they will record and how the process will go. If things do not feel right for you, then you can always cancel a report without consequences.

Can I, as a result of a report, end up in a deportation process?

Your report will not result in a deportation process. The Amsterdam police developed the free in, free out protocol. This protocol has now become national policy. The free in, free out principle means that people without a legal domicile can safely enter and exit a police station and report a crime without any consequences to their stay in the Netherlands. Safe reporting, free in, free out, also applies to witnesses, for example. Free in free out does not apply to those who are flagged for a crime in the Netherlands or abroad and are thus wanted by the police. Will I be fined for breaching curfew if I report an offence that occurred between 21:00 and 04:30?

No, you will not be fined. The police does not fine breaching curfew if you call for assistance or file a report later.

Will I receive a fine for unlicensed sex work from home if I report an offence that took place through sex work from home?

No, you will not be fined. The police does not fine unlicensed sex work from home. The police exclusively tries to solve the offence you reported.

Will the police record my address?

During the first meeting, the police will explain to you which information they will record to be able to solve the offence and how the process will go.

If you do not wish your address to become known, or if you do not wish to receive mail at home, then it is possible to provide a different address (e.g. P&G292) as correspondence address for the report. Choose an address you can visit regularly to retrieve your mail.

Will they record the address if the offence took place at my home?

The address of the offence (reported by you) will only be recorded in the criminal record. This criminal record can only be viewed by the people (police and public prosecution office) directly involved in the case to punish the offender. Other police officers or staff of the public prosecution office are not permitted and cannot access your file. The police will not share your file with the municipality.

La policía no compartirá tus datos, ni siquiera con el ayuntamiento. La policía solo anotará lo necesario para encontrar al autor del delito. Durante la primera entrevista, la policía te puede explicar exactamente qué información va a recoger y cómo funciona el proceso. Si esto te produce inquietud, siempre puedes cancelar la denuncia sin consecuencias.

¿Puedo acabar en un proceso de expulsión como resultado de una denuncia?

Tu denuncia no va a llevar a un proceso de expulsión. La policía de Ámsterdam ha creado el protocolo de entrada y salida en libertad. Este protocolo se ha convertido en política nacional oficial. El principio de entrada y salida en libertad significa que las personas sin permiso de residencia pueden entrar y salir con total seguridad de una comisaría de policía y pueden denunciar un delito de forma segura sin que esto afecte a su estancia. La denuncia sin riesgos y la entrada y salida en libertad también se aplican, por ejemplo, a los testigos. La entrada y salida en libertad no se aplica a las personas de las que se ha informado que han cometido un delito en los Países Bajos o en el extranjero y, por lo tanto, son buscadas por la policía. No, no se te pondrá ninguna multa. La policía no multa por el toque de queda si llamas para pedir ayuda o presentas más tarde una denuncia.

¿Me pondrán una multa por trabajo sexual no autorizado a domicilio si denuncio un delito que ha tenido lugar a través del trabajo sexual a domicilio?

No, no se te pondrá ninguna multa. La policía no pone multas por trabajo sexual no autorizado a domicilio. La policía solo intenta resolver el delito que has denunciado.

¿Anotará la policía mi dirección?

Durante la primera entrevista, la policía te explicará qué información tiene que recoger para resolver el delito y cómo funciona el proceso.

Si no quieres que se sepa tu dirección o si no quieres recibir correo en casa, es posible dar otra dirección (por ejemplo, la de P&G292) como dirección de correspondencia para la denuncia. Elige una dirección a la que puedas acudir con regularidad a recoger tu correo.

Si el delito ocurrió en mi casa, ¿anotarán la dirección?

La dirección donde ocurrió el delito (denunciado por ti) solo se incluirá en el expediente penal. Este expediente penal solo puede ser consultado por aquellos (policía y Fiscalía) directamente involucrados en el caso con el fin de condenar al autor del delito. Otros agentes de policía o empleados de la Fiscalía no pueden ni tienen permitido examinar tu expediente. La policía tampoco compartirá tu expediente con el ayuntamiento.
